Terms of Service

These terms govern your use of Ekome — the mobile application, this website, and any related services we operate (together, "the Service"). By creating an account or using the Service, you agree to these terms. If you don't agree, please don't use the Service.

The product, plainly

Ekome is a voice journal. You record voice notes. The Service transcribes them, drafts content from them, and surfaces past entries back to you at meaningful checkpoints. Ekome is a curator and a prompter — it does not analyze, score, or interpret you.

Eligibility

You must be at least 16 years old to use Ekome. By using the Service you confirm you meet this age requirement and have the legal capacity to enter into these terms in your jurisdiction.

Your account

Sign-in uses a third-party identity provider. You are responsible for the security of the account you use to access Ekome. If you suspect unauthorized access, sign out of all sessions from inside the app’s feedback option.

One account per person. Sharing accounts is prohibited.

Your content

You own the audio you record and the transcripts and drafts derived from it. Your content remains yours. You grant Ekome a limited, non-exclusive licence to host, process, and produce drafts from your content solely so we can operate the Service for you. This licence ends when you delete the content or your account.

We do not use your content to train any AI model. See the Privacy Policy for how content flows through the Service.

You may use Ekome only for your own reflective journaling and the personal content it produces for you. You may not:

Safety — Ekome is not therapy

Ekome is a notebook, not a clinician. If you are in crisis, please reach a person.

Ekome is not a medical device, not a mental-health service, and not a replacement for therapy or professional care. The Service may, in response to language that suggests you are in crisis, surface a list of regional helplines. It does not diagnose you, treat you, or provide medical advice.

If you are experiencing a mental-health emergency, please contact a qualified professional, a regional helpline, or local emergency services immediately.

AI-generated drafts

Content produced by Ekome — notes, email drafts, social posts, follow-ups — are drafts generated based on what you said. They are starting points for you to review and edit. You are responsible for whatever you send. Ekome does not auto-send. Every send is your tap.

AI-generated content can contain errors, omissions, or misinterpretations of your meaning. Read before you send.

Subscriptions and payments

During the v1 launch period, the Service is offered free of charge. We may introduce paid plans in the future. If we do, the terms and pricing will be disclosed before any payment is required.

Account deletion

You can delete your account from inside the app at any time. Upon deletion:

Suspension or termination by Ekome

We may suspend or terminate your account if you breach these terms, use the Service unlawfully, or if continuing to provide the Service to you would expose Ekome or other users to significant risk. Where circumstances allow, we will give you notice and an opportunity to cure the breach.

We may also discontinue the Service entirely. If we do, we will give reasonable notice and a way to export your data before the Service shuts down.

Disclaimer of warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, Ekome disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that transcripts and drafts will be accurate.

Limitation of liability

To the maximum extent permitted by applicable law, Ekome and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim, or, if you paid nothing, to ten US dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the maximum extent permitted by law.

Indemnity

You agree to indemnify and hold harmless Ekome and its operators from any claim or demand made by a third party arising out of (a) your content, (b) your use of the Service, or (c) your violation of these terms or applicable law.

Governing law and disputes

These terms are governed by the laws of the jurisdiction in which Ekome's operating entity is registered. Where you have a statutory right under your local law (for example, EU/UK consumer protections, DPDP grievance rights in India, CCPA in California, LGPD in Brazil) to a different forum or law, those rights are unaffected by this clause.

Changes to these terms

We may revise these terms. Material changes will be flagged in the app at least 14 days before they take effect. If you continue to use the Service after the effective date of a revised version, you accept the revised terms.

If you have any concerns or questions in relation to these terms, please use the in-app feedback option.

Draft note for legal review. This document was drafted from Ekome's product commitments. Before public launch it should be reviewed by counsel competent in the relevant consumer-protection regimes and Play Store / App Store policy compliance. The "$10 floor" liability cap, the 16-year age threshold, and the indemnity scope are conventional but should be tuned to your operating company, your insurance, and your target jurisdictions. The current "Effective" date reflects the draft date, not a binding effective date.
